Issue
A Business Event is created in Class after a Release Authority payment is confirmed, even though the member has already paid the liability personally. The Business Event cannot be deleted.
Cause
This issue typically occurs when:
- A member receives a Division 293 Notice of Assessment
- The member elects to release money from super
- The ATO issues a Release Authority to the SMSF via SuperStream
- The member then pays the Division 293 liability personally
- The administrator confirms the Release Authority payment in Class for the SuperStream message
Once the payment is confirmed in Class, a Business Event is automatically created.
Resolution
Class has received the following guidance from the ATO in relation to this matter:
"Once a successful Release Authority outbound response message has been supplied, the fund is considered to have complied with returning the Release Authority Statement. There is no agreed system/process in place within the current SuperStream standards to cancel or reverse a Release Authority or Release Authority Statement.
Failure to make the related payment, however, is a compliance issue and the SMSF could be subject to future compliance action."
Once a valid Release Authority is issued to the SMSF by the ATO expects that:
- pay the required amount to the ATO within 10 business days AND
- return the Release Authority Statement to the ATO within 10 business days
- Contact the ATO to resolve the issue.
Even if the member has already paid the Division 293 tax personally, the SMSF is still required to respond to the ATO‑issued Release Authority.
